Two parts: Is it true that hoa covenants provide an “extra layer” of protection and/or restriction to it’s members on top of state law? Second, if that’s true, and the covenants require a 70% written agreement to amend the covenants, can the hoa board sidestep this provision by citing state law, which allows in absence of a ballot or no-vote to be counted as a yes to amend the covenants?

Does an HOA have the right to spend our dues for specific childrens’ activities such as parties and parades with prizes bought with my dues money? (We don’t have any children)

What about prizes given to individuals for Christmas and Easter celebrations, such as buying parties aupplies and awarding gifts/prizes for best costumes, etc.?

My husband purchased a townhouse near our home when we were separated. We got back together and could not sell the townhouse so we rented the propertry instead of going into foreclosure. The HOA is sueing us for renting the property. What can we do?

When we moved in to our condo back in April of this year. I have three children and somehow my son was left off the associations papers. Now our HOA chairman is telling me we have to pay an additional $75 by monday. (he just stopped me in the lot today)

Our HOA is out of control. There is one man who has basically taken control of the board. He does not give out any information or allow the contact of owners to other board members. He is paying his self a salary from the HOA, he is in control of the HOA financial documents etc. This person is not even an owner. He is simply a renter and employee of the HOA. We have got a group of owners who would like to take over the board and have this person removed. What/how can we do this?

Foundation Problems

I purchased a Condo 2 years and 3 months ago. A few months after I moved in I found out that the board had reason to believe that there were problems with the foundation of my unit. They never disclosed this information to the previous owner. We did not pursue the HOA at the time as we did not know if it was a material issue and they were in the process of testing the soil. They recently did some additional testing on the foundation. I requested a copy of the report but they are refusing to release it. Do I have legal action against them?
