What action can a homeowner take when a HOA does not adhere to the Uniform Planned Community ACT within Georgia? Isn’t there someone that oversees HOA’s?

We purchased a condo in the Alpharetta, GA area five years ago. We purchased this property, because we were told at closing that we wouldn’t have any conflict with the HOA in renting the unit. We were required to have approval for our rental signage and several other things. We did not purchase another condo because it would be difficult to keep as rental property. Three years into ownership, we have a new HOA Board and Management Company. The Board doesn’t want to allow owners to rent their property. Do we have any legal right to maintain the old rules of the Association? We purchased the condo prior to this Board or new Management Company taking over control. We are truly being harassed.

We have a president over the Association that him and his wife thinks they are GOD. They have changed the rules at the pool that we can not have food or water/Drinks in the pavilion area. The wife yells at everyone at the pool and we have homeowners that REFUSE to pay the dues because of them. I’m having a meeting on Thursday June 17th at 7pm at the pool. How can we get this president OUT? They say they will not have a HOA meeting because no one shows. Well they do not show because of the Jacksons.

What Can we do? Do we have to have a lawyer?

My HOA raised our monthly fees in January, however I was not made aware of this through any type of correspondence (I continued to pay the same amount I have the past three years). I only found out last weekend when they simply refused to reprogram our pool key so we would have access to our amenities. They are now demanding the back pay for the increases that I was unaware of (which I don’t have a problem paying). They are also requiring that we pay a late fee for each month that the full amount was not paid. Is it required that they provide some notice of delinquency in payment before demanding late fees or is this acceptable?

I bought a wooded lot in Ellijay, Georgia, a year ago. I pay over $500 per year as association dues although I do not live on the property and have no building structures on the property. The complex does have a pool and clubhouse, so I understand the need for dues overall, but I was wondering if I should be paying the entire amount each year.

I live in Smyrna, GA (located in Cobb County). My homeowner’s association does allow anybody to attend any of the monthly board meetings held one weeknight per month. However, many of us are unable to attend for various reasons and have requested that the Board post the latest minutes and financial statements on the HOA website. Having been refused, we then asked that the Board would provide copies of these documents to any resident upon request. They refused again. Their position is that since the HOA Board meetings are open to all residents, then they don’t have to provide these documents. Can you tell me what, if any, are the HOA’s legal obligations with regard to making financial statements and meeting minutes available to their homeowners.

I live in a 20 year old subdivision in Georgia. We have recorded covenants but no formal HOA. Some of the neighbors want to form an official HOA. What is the minimum number of lot owners that must vote yes in order for it to become binding for all? Where can I find this information in the Official Code of Georgia? Thank You.

Plz. help! We live in Smyrna, Ga. Our homeowners assoc. is called Community Management Assoc. We have a leaking roof on our main level in our home. They ignored all of our emails, phone calls, etc. over the holidays. If the roof caves in, were responsible for it! They FINALLY did something about it on today ONLY AFTER MY HUSBAND VISITED THEIR HOME OFFICE AND DEMANDED ANSWERS! In the bylaws it states that we cannot sue. If this particular act is deemed Negiligence, what recourse do we have to take? We cant just sit at our house and “twiddle our thumbs” waiting for the roof to cave in!!! I left a msg. with a lawyer here in Georgia and am waiting on a return call. Please help in any way that you can! have a leaking roof in our townhome
