Is this possible even if the victim did not sign the charges?

charges were filed against my husband for theft by the police officers. my mother, which is the victim wants the case dismissed due to the fact she wore the jewelry numerous times after the officers claimed he so called pawned the jewelry. my mother as been trying to get a hold of the officers to explain this however they are avoiding her. i heard that in some cases if the victim refuses to testify the case can be dropped. Is this possible even if the victim did not sign the charges?

In reference to the answers in my first posting, I know that this woman who has falsely accused my husband has no money and if I sue her I wouldn’t get anything. However, if I sue her for our expenses and deformation of character and she does not pay, would she be possibly put in jail. That would actually be just as satisfying as getting the money back if not more.

My husband has been falsely accused of rape and our attorney has stated that the court system will likely drop the charges because of lack of evidence and since the DNA tests which were taken came back as negative. This incident which he did not deserve to have happen to him has caused him to spend over a week in jail resulting in over $1300.00 in lost wages. The police also impounded his truck which had my work keys and laptop in it, this resulted in around $600.00 in lost wages for me along with the fees to get the truck out of impound. We have spent close to $15,000.00 (including attorney fees, fees from the jail, charges to get our truck back, etc…) just to get through the situation. Not to mention the mental and emotional anguish of having our family separated that way. I want to know what we can do to get some type of retribution for the situation since the woman he was accused by came to a gathering at our home uninvited and was asked to leave multiple times before she actually did. Then after she left, she reported that my husband raped her and the police arrested him even though there were at least five witnesses who told them that he had never been alone with her. I know that placing a false police report is illegal, but I am also concerned with the deformation to my husbands character, and the money we have lost. What can I do within the law?

My question is about making a false report that my boyfriend got violent with me. He is now in jail and I feel completely horrible because I made the story up just for revenge. I did not know that they were going to do this. Anyway. I have an appointment to Thursday to confess that I did in fact make a false report. I live in Colorado and I don’t know what the consequences will be for me? I am also 35 weeks pregnant. So what will happen to me?

My Sister was in Macys with her friend. Her friend took something from the store and my sister had no idea. The people in the store brought them both in the back office and went through her purse as well as the girl who “actually stole something” My sister had no part in it and it was HER BIRTHDAY to make the day more embarrassing. We both know people in loss prevention and was told it is illegal to go through a purse or detain someone without cause.. Is that true. ? she was embarrassed and had other friends that had to watch her go through this. Again she did nothing wrong and had no part in it. PLease let me know. I am so angry at someone treating her like a criminal

false stalking order in Oregon

My sons ex-wife has been granted temporary relocation to Oregon but has to return to AZ for hearing. The woman with whom his ex-wife is living with and working for filed a stalking order against my son on herself stating that he is harrassing her. The whole order is false & full of lies. My son had the initial hearing today telephonically and there is a hearaing scheduled for 1-26-2010 for which he has to appear if he wants to fight this, which he does. He has an attorney in AZ for the upcoming relocation hearing and having to obtain a lawyer in Oregon also may not be financially possible. Any information on maybe Attorneys that provide legal coaching in Oregon or on how to prepare for this pro se would be greatly appreciated.

Im so scared my boyfriend was recently accused of a robbery that he didn’t commit. He’s been in jail without bond and they are threatening him with 10 years minimum. The police say he fits the description of one of four men who robbed a U Haul store. But they wont say what that description is. They also said they have evidence and they it on tape, but when he asked to see it they refused to show it to him. Two stores and witness told the police that he was at their stores and couldn’t possibly have done it but im so worried they’ll continue to accuse him. They still have yet to even set bond. Please help!

my son has been incarcerated for alleged act of stalking his ex girlfriend. He lives 3 hours away, and has disabilities. He cannot drive a car. He has to rely on his girlfriend for transportation. He has also been cleared of charges of calling and harassment on the Land Line Phone and mine and his brother’s cell phone. We do not live in Duncan, we live in Tulsa. There is no way this could happen, but he is in jail for doing all of this. He is accused of being somewhere he was not on here say. He was never seen at this residence. She went from saying she heard knocking at the door and then she got a call on the phone saying it was him coming to get her to him knocking at the door and saying who he was. The judge looked over the facts and sent him to jail with a bail of $5,ooo.oo on stalking charges saying he has been doing this for six months even with evidence that he wasn’t in Oklahoma and had no access to my phone or his brother’s phone. After i changed my number, she still said the calls were coming from my phone as well. the judge dropped the phone charges, and while we were waiting to go into court, the police came and arrested him saying he had been charged for stalking for 6 months. How can that be if cleared and there is no legal evidence of the incident. No one saw him, all the information was here say and her story changed each time she was asked about the incident. Also, when she said her was at her home, he was on vacation with his girlfriend and her father in another state.

one day, i was trying to decided what to buy with my money at a store called Mac’s. i guess that i spend quite a lot of time thinking, my thoughts fighting over chips or candy. when i made my choice, the cash register randomly searched through my personal belongings (my backpack) as well as my body. i knew that i had not taken anything, and i was really angry about their accusations. i once remembered that someone told me that it was illegal to accuse someone of shoplifting until they had left the store. is this true? and if not, when are u allowed and not allowed to accuse someone of shoplifting?

My boyfriend is in court for raping his ex girlfriend (sexual assault). I know he didn’t do anything because he wouldn’t do that. Before he was with me his ex kept sending him pictures for he naked and text massages saying she wanted to have sex after school ( this is a 15 year old and hes 18). He didn’t want to have sex with her cause he was waiting for the right girl, and she keeps bugging him. Whats evidence would they look for on the victim?
