My 20 year old daughter was caught shoplifting about $12 worth of merchandise from a grocery store. She was taken to a room where she was asked to show her driver’s license. Her picture was taken and she was asked to never step foot in the store. She was also told to expect something in the mail and probably pay a fine. Then she was released. Will she have a criminal record? What will happen? This was her first offense.

My daughter does not know if it was only store employees involved, but claims that a man did flash a badge (but this doesn’t confirm that the man was a police officer, right?). We have still not received anything in the mail.
We received the letter today. It states that my daughter was detained in conjunction with Chapter 20 of Title 2C of the New Jersey Statutes. There is a punitive damage fee of $125. Of course, I will make that payment, but what happens then? Does she have a criminal record? How will this affect her future?

Was it only the store employees that were involved? It doesn’t sound like she will have a criminal record. It might be worth it to contact a criminal attorney in your area for guidance, you don’t want to mess around with a criminal record.
