Is it true that a Domestic Violence restraining order which is a public record prevent a person from seeking gainful employment? The restraining order was filed in Dec/2000 in Raleigh, North Carolina. After the 10 days waiting period, the abused person did not make an appearance at court and the case was dropped. This person now claims that he can’t find employment from that time until now because employers can do a background search of public records and therefore not hire him.
If this claim is true, would it be a legal remedy for the abused person to issue an affidavit of “retraction” or any similar statements to show to prospective employers? The person is seeking and pursuing this relentlessly from the abused person. What would be the legal consequences for the abused person writing this “retraction”.

I am thinking this person should get an expungment of the charges. This way, it will not show up on his/her record for background checks. There are a lot of posts about expungment at: http://askinglaw.com/category/criminal-law/expungement
