My sister’s husband left her 3 weeks ago, 1 week ago he came to pick up his belongings and they discussed divorce, nothing legal was filed. He died and she is now trying to pick up his clothes, car, miscellaneous property that he had taken to his sister’s house whom he was staying with during the separation. We are getting conflicting advice on her rights. The sister is not being cooperative. He, of course, died with no will.

His items belong to your sister unless there is a will stating the items go to his sister. I would immediate seek legal representation so she can recoup the items which rightfully belong to her. The only way his items can be taken from her such as a car is if money is still owed and it gets repossessed.
