Okay I have a question….Does moaning and groaning from approximately 11:30/12:30am all night until approximately 6:30/7am from sex, under my bedroom, which can be heard in my apartment, constitute as a violation of the Right of Quiet Enjoyment? I have brought it up in conversation/telephoned her/ written to her etc to no avail ~ last Friday night Feb.10,2012 my Diabetic 11 yr old son was so sick and in between his vomiting all that could be heard was her moaning downstairs!! I called her and of course she didn’t answer, and never stopped!! She has NEVER even addressed it, and was at it again 2 nights ago ~ I have a heart condition, I am on Disability and we live in a Section 8 apt…..PLEASE, help me with an answer to my rights. Thank you!

So we are to believe she is having sex everynight for six hours! Have you complained to landlord?
