Can I get a restraining order against my neighbor who purposely tries to annoy us?
Our neighbor leans a 1×8 board over our five-foot-high fence line. He purposely positions the board so the last two feet lean into our property space.
In May 2008, he positioned the board over our Dahlia garden. After a few weeks we moved it back onto his fence line property. Since June 2008, he moved the board next to his work shed and over the fence line again.
We have not moved it since May, hoping he grow up and remove it. Instead, he continues to position the board more and more into our property space.
He could easily store the board in his work shed or in his garage.
We believe he is annoying us on purpose because he is immature and cannot accept our property rights. We keep some covered property next to our garage.
There is a six-foot-high fence between his kitchen/back porch and our garage. He built the fence two years ago with our permission. Even before he built the fence we stored our BBQ (with a black cover) on the side of our garage.
After the fence was built, we continued to store the BBQ and a child’s bicycle (also covered with black material) on the side of the garage. It’s a small one-car garage where we park our car and store tools, etc.
On August 3, 2007, he asked us to move the items because they were “an eye sore.”
We figured out that he put a Weber BBQ off his back porch. While he cooks he must look through the fence (that he built!) to see our two covered items.
Can we take some legal action? Advice is welcomed.
