Our homeowners association, without the approval of the homeowners, hired (at the cost of the homeowners) a property management group to manage homeowners’ association. The HOA members were not allowed to vote on this decision, affecting annual dues. In addition, questioning this decision is viewed as a threat. The management company’s lawyers have drafted and delivered letters threatening to sue members who raise questions or try to get the community to speak up.
What rights do the homeowners have? The board continues to file amendments to our HOA policy (without homeowners approvals) to increase fines, fees, and to send HOA members into collections if they do not pay the fines/fees on demand.
