What state and town do you live in? Is there any documentation or correspondence when you say "the Developer has tried twice to turn the development over to the HOA"
When I was secretary of my HOA, all elections were done via meetings and had to be done in person. No one ever showed up. I became secretary of the home owners association by default. I then had to write bylaws from scratch. Good luck.
