Is there any documentation or correspondence when you say "the Developer has tried twice to turn the development over to the HOA" When I was secretary of my HOA, all elections were done via meetings and had to be done in person. No one ever showed up. I became secretary of the home owners association by default. I then had to write bylaws from scratch. Good luck. What state and town do you live in?
