I purchased a brand new home in Texas that was part of an HOA. The home is a rental house and I am an out of state owner. The Management Company never sent me an invoice or any form of communication. The annual HOA fee is $440. Recently a lawyer/collection agent called me and said I had unpaid HOA fees and it would be $2600 to clean it up. Penalties, interest and there fee. I have no problem paying the HOA fee and actually already sent the Management Co my $440.

My question is do I have any recourse on the remaining $2160? The management company never sent me a bill. They said they sent it to the house but 5 minutes of research to look at the title would shown them my real address. If they have no obligation to send me a bill, is there any limit to what they can charge me? I mean 500% is outrageous. Does the management company have an obligation to show due diligence to get me a bill?
