Help with handling insurance with DUI accident

Posted on : 12-28-2007 | By : Legal Information | In : Criminal Law, DUI & DWI, Insurance Law, Other Legal Topics

I was involved in an accident with a car. My car flipped. I got a DUI. We both sustained minor injuries. When I stopped another car hit me taking minor damage. My car looks totaled. I called my insurance agent and he had me call the claims people. I called and gave vague information. I said someone else was injured. They said they were passing my claim to their bigger office. A woman called me and left a message saying she was from the claims office and had questions about the accident. How should I handle the insurance company now (the other guys lawyer called to ask for my policy already)? I still have not had my arraignment or any court dates, if that matters.

Wait! Do not contact or get in contact with any insurance company just yet. What you need to do is contact a DUI attorney in your state and perhaps one that also defends personal injury cases. After contacting a DUI attorney you will want to read the fine print on your insurance policy. I’m sure there is something that states if you are involved in an accident while under the influence of alcohol and drugs they are not responsible for any damages caused by the accident. This means if you are charged and convicted of a DUI than your insurance companies doesn’t pay a dime to the other person and more than likely your policy will get dropped. It would be your responsibility to pay for all damages and injuries that occurred.

Here is another problem because you were under the influence of alcohol the other person will claim that you caused the accident. Regardless of how it occurred chances are you will be at fault. So before you do anything, and I mean anything, contact a lawyers ASAP.

Do not and I mean do not talk to your insurance company or the other persons insurance company until you have consulted with your attorney.

Good luck

This is correct. If you are involved in an automobile accident due to the over consumption of alcohol than its quite possible that your insurance company will not cover the costs for repairs or damages to both your car or the other persons car. It is imperative that you contact a lawyer immediately. In these sorts of instances, your attorney will do the talking for you.
