H1 visa and Human Resources -New York, NY

A family member has recently been offered a job at a university by the head of her department where she has been working for several years with a TN visa. This offer would afford her H1 status. However, the Human Resources Department says they “don’t do H1s” and are refusing to engage in the process. Do they have a right to do that? If not, what recourse does she have?

From what i have read, a company or institution must be a willing Sponsor for any H1B visa. I would have your friend talk to his contact at the university to see if he or she can help put pressure on Human Resources. HR may just not want to deal with the hassle and paperwork for H1B Visa.
