grandfather law

There is a rock quarry behind my house and the business has changed dramatically. The owner claims he is grandfathered since 1922 to mine rock. He is in a residential zone area with many homes behind him. He is recycling concrete (breaking it into aggregate) which he never did before, creating noise that is totally inappropriate for a residential area. The diesel fumes from all his machinery come over on to our property. He has two recycle permits one from DEC and one from the county even though he claims he is not recycling. Apart from getting summonses from the DEC for bad soil samples (they found glass that he was not allowed to break up) he seems to be able to do what he wants. How does he get away with this? This law seems very antiquated.
