Is the mother disputing that he is the father, or does she concede to that? If she disputes it, then you are probably looking at a paternity test and more money.
Is your brother fighting for just visitation or custody as well? Has he paid any child support?

no he doesn’t pay child support and there is no dna problems but he do wants joint custody the thing is when his baby mother took the child away she drop the baby off over her parents house her own sister have said that she is not taking care of the child like she is supposed to my brother wants custody of the child but if he can’t get that he at least wants joint custody oh yeah would it be difficult to get custody due to him being out of his daughter life for two years even though the mother won’t allow him to be in the child life

No there is no dna problem
He has never paid child support but he has brought her clothes,toys ect but she won’t let him know where she’s at so he’s not able to give it to her

There is not much your friend can do except find a family custody lawyer based in Illinois. The mother of the child is not cooperating, so you will need to get the law involved. There is also a possibility that there will be some child support dollars owed or paid. Consult the lawyer about this.

I filed for child support in November 2007. I have recieved only one payment since. My child’s father filed for visitation rights directly after the judge ordered him to pay. He never showed up to the court date for the visitation. He says he shouldn’t have to pay child support and wants joint custody so he won’t have to. We have a court date later this month for his failure to pay any child support. He is now threatening to sue me for joint custody again because he doesn’t want to pay the support. Along with not paying child support, he rarely sees our child because he is busy. I need to know what rights I have and what his rights are as a father.

Was the father ever married to the mother? If there was a divorce, the child support, custody, and visitation should have been drawn up already. If the father and mother were never married, the father might want to see a family lawyer in the Illinois area to fight for visitation rights.
