fall, do i have a case against the owner of the house i rent ..

i got locked out of my house on my balcony so i decided to climb down i got on the other side of the railing and was going to hang down but the railing broke and i fell and broke my heel bone do i have a case against the owner of the house i rent or not

Hi, I am an attorney in California. The following should be considered general information, and is not intended to be legal advice. That said, you should contact an attorney in the state where you live/the accident occurred.

There are lots of issues that need to be addressed before one can determine if you have a case or not. I suggest you take photos of the balcony, both from on the balcony and from below.

Some of the questions to consider: How old is the home? How old is the balcony railing? Was there ever a problem with the door locking before? Was there ever a problem with the balcony before? The railing was likely not meant to support a person’s hanging for any length of time, but that would be a consideration as well.
