what is the statue of limitation on DUi in the state of Oh? Can I use mental illness as a defense? I was taking mental illness meds and overdosed by accident and then drove. the cops found an old empty can of beer in my vehicle and then charged me with DUI. THey also said I refused the breath test, but I don’t even remember then picking me up and taking me to the hospital where I was admitted as totally unresponsive. My blood ach level was over the limits by a very very small margin, but I have found medical studies that conclude that some of my medications cause false blood ach levels when mixed with ach. I had drank one beer like 5 hours before i drove. Will this defense stand up in court to get the DUI removed?

DUI received in 1990. I now live in the state of Ohio, and the State of North Carolina has put a block on License Renewal for the State of NC because case was not disposed of.
