I was issued a summons:
801 42-4-1301 drove vehicle while ability inpaired by alchohol.
when I took a breathalizer it was0.007
Officer pulled me over becuae he claimed i was going 55in a 45. Which I was not and he didnt have a radar to show me and I was on the road for less than a 3 minutes.
I came out of a restaurant, had 1 vodka. When I took the balance test etc….I passed. When he handcuffed me I said, you know Im fine why are you doing this he said it was because when he did the pen test my eyes shook a bit.
He was really stretching it.
