My dog broke through our fence and attacked a neighbor’s dog while she was out walking her. Her dog survived, I offered to pay the 3700.00 in medicals bills. They have threatened me with a civil suit for damages and pain and suffering on top of that. They also claim that I was negligent. My dog has never had violent tendencies, never has bitten anyone, most of the neighbors didn’t know I had a dog. My dog was in my fully fenced yard, and for some reason she broke through the fence and attacked this dog. t show any aggression to any human involved, including the officer. 1) Isn’t a dog considered personal property, not an extention of a person, so they can only sue for medical bills. 2) can I be negligent if my dog was not running loose, but in a fully fenced yard 3) How long does it normally take for a civil suit to actually go to court ? No, not yet. I was just wondering if anyone knew the law because I have a friend that’s a judge here in Texas and she thought (not her area, she’s in juvie court) that animals were considered property, not extentions of their owner, so they are only entitled to property damage (dr’s bills) not pain and suffering, etc. Also, negligence would be hard to prove it the dog has not had any prior incidents or was not violating the lease law and was penned up with reasonable expectation of contatainment. Thanks

Have they actually filed the suit yet? I’m not sure about what the law is in Texas regarding dog attacts on other dogs. You made a fair offer to pay for medical bills which they refused. I would consult a lawyer to counter the possible civil suit.
