Divorce – LLC

My divorce took over a year. It was finalized in December 08. I started a business in 2001 which is a Limited Liabilty Partnership and my ex-wifes father is my partner. We are now working on dissolving this partnership, just like a second divorce. I never had court orders for alimony or maintenance but I did agree to give her half my income ($5600)/month until the divorce was finalized. Over the course of 2008 she manage to take out a total of $180,000. Now the partnership tax returns have been prepared for 2008 and all the draws she took were applied to my K1. (Did I mention that her mother has been my bookeeper for the last several years?) So not only did she take the money, but It looks as if I will have to pay the taxes. Is there any hope? Our divorce decree states that she is to pay the taxes on any income, but it looks as if this was not considered income. HELP
