My daughter was hit in the face on 8/18/07 with a pool toy which caused a laceration and she now has a scar. The only warning on the package is about small objects can choke if swallowed. Would I have a case against the manufacturer?

Was the toy small enough to be swallowed? If so, I would imagine that the toy must have been thrown at a high rate of speed. If there is defect that caused this throw, then you might have a case. If it was someone who threw it at your daughter, you probably have a better chance suing the invidividual for personal injury.

It really depends upon the situation. How did the accident occur? Did your child land on it or was it thrown at your child? There are obvious situations in which any toy could hurt a child and it wouldn’t be the manufactures fault. For instance, if a toy was thrown at your child or if your child landed on the toy it wouldn’t make that toy unsafe.
There are two things I would recommend. First got to this site http://www.cpsc.gov/ - These are the latest recalls.
Second, if you believe the toy is unsafe and the injury occurred because of the toy, than you may want to talk to an attorney that handles product liability cases.
