The govt. is holding our vehicle that was impounded. They dropped any forfeiture issues concerning it but we can’t get them to release it. It has been 2 months since the forfeiture issue was dropped and we can’t get any answers from them. Any suggestions on what we can do and what are our rights?

Kenny no the vehicle wasn’t illegally confiscated but they have officially dropped all forfeiture issues. When we contact them they tell us its still pending and they will take care of it when they get time. We were not the ones in the vehicle when they confiscated it. It just seems that as taxpaying citizens we should have some rights. We have sent 2 certified letters and our attorney has tried contacting them but they won’t return his call. Any other ideas? Thanks
What does your attorney say about the whole thing? If they are saying its pending doesn’t this mean that the case is still open? If its close and they are saying the release of the vehicle is pending I would ask them why is it still pending if the forfeiture issue has been resolved. The problem is that it is being held by the government and the government trumps all. I’m curious to find out what your attorneys take is on this case. Please explain…
They say it is pending because they are too busy and haven’t had time to work on it. Which actually means that they are trying to get as much from us as they can on the fines and impoundment fees. Our attorney has researched it and said that we have done all we can and that all we can do is wait. But you are right the govt. can and will do whatever they can and if the law isn’t in their favor they will change it. As far is what they mean by pending I have no idea everytime I ask she said its pending and when I explain that the forfeiture has been dropped and that they have no reason to still be holding it she says they are too busy and that they will get to it when they have time. She also said at one time that it had been sent to another agency and when I questioned her about it she wouldn’t tell me what she was talking about because she said it was confidential. I don’t know or understand any of it. I’m just an American who didn’t realize how messed up our govt. was until now. haha
If the Government decides that they have probable cause to seize your vehicle you can’t do a thing. Furthermore you have to prove to the Government that indeed you are not guilty of the charge (they don’t have to prove a thing). This is happening not only with cars but other high ticket items as well. Find out from your lawyer if you can recoup any of the costs associated with the impound fees. If you have dealt with any type of Government agency in the past you probably already know how lazy and incompetent they really are. Half of the employees can even put together a full sentence.
I wouldn’t even be a bit surprise if they lost your car in the shuffle. For all you know, you car probably went out to auction weeks ago!
It better be right where they say it is or there will be some legal action. Another question does anyone know what other govt. agency she would have been talking about? As for keeping it they have already dropped any forfeiture issue on it because they determined that we were not involved in the illegal activity and knew nothing about it. It just makes me mad because I cannot believe that these are the values that this country was founded on and the people we are supposed to trust to keep us safe are the ones we need protecting from! If anyone has any ideas on what we can do as the next step in getting them to release the vehicle please let me know.

Did they falsely impound your vehicle? If so, you may have certain rights just from that. I would write a certified letter to the office stating that your vehicle was falsely impounded and if you do not here back from them within a certain time, you will be taking legal recourse for both the inconvenience as well as to get your vehicle back.
You could also have an attorney write up the letter as well. This seems to really work. I have gone through a similar situation with other situations and when you start talking about getting a lawyer aka “your lawyer” involved you would be surprised to see how quickly they will act. Good luck
