Hi,
My partner was arrested for domestic violence on felony charges but they were dropped. My partner was again arrested for domestic violence but on misdemeanor charges but they were again dropped. We have mutually decided to call it quits for the sake of out 7 month baby.

Will the court take any of my partners arrests into consideration to determine child custody?

Yes, courts will absolutely take into account your partner’s abusive criminal record when considering child custody.
Courts look to the best interests of the child when deciding child custody issues, looking at such things as: lifestyle and social factors of the parents, stability of the relationship, ability of the parent to provide for the child and also nurture an appropriate relationship.
Clearly issues with anger and abuse will work against your partner’s attempts for the various types of custody.

Can court? Yes will they or shoud they? No. Since charges were dropped there was no crime (in theory and according to law) to use it now woud be a violation of rights I would think
