My three-year old daughter was bit by her grandmother’s dog a week ago. It was a deep bite and required very a very traumatic trip to the emergency room with sutures.
My daughter’s father is telling me that I over-reacted and that my daughter would have been fine if I hadn’t taken her to the hospital.
I do not want my daughter around the dog again however both her father and grandmother refuse to put the dog outside when she is there or to put up a gate in the house so the dog isn’t around her. (Her father lives with grandma) This wasn’t the first time the dog has bitten her but it is defenitely the worst.
In my opinion the only way to prevent this from happening again is for her to be no where near the dog ever again.
I have refused to take her there since the accident and now her father is threatening me with court action to get custody of her. I haven’t refused to let him see her but they want her to spend time at the house with the dog.
Am I being unreasonable? If we went to court over this would a judge think I was being unreasonable and make me take her to the house? I am very concerned about her safety and always feel it is better safe than sorry, especially when there is no real benefit for her being around that dog. I want her to spend time with her father but not at the risk of being injured or disfigured!

How was custody of your daughter first agreed apon with the father? Was there a divorce? What do the custody agreements say? You should get a family lawyer based in Santa Barbara County, CA and consult with them. At first glance, it seems like the judge would side with you, but you should have a lawyer work with you on this. the dog bite issue is crazy. Your daughter is only 3 years old and had to have stitches from a dog bite and the daughter and father don’t seem to care?
Take pictures of the injury (if it is not too late). Make sure that you document the hospital records and bills. If you get asked by a judge to explain what happened, be prepared.
Dogs can be dangerous animals, especially with young children, I think you should do what ever you can to protect your child from this dangerous situation.
