My daughter is only 16 years of age and has the stomach flu really badly to the point where she cant even get out of bed and i need to take her to the doctors.. She has court this coming friday october 23 09. I don’t think she will be able to make it i was just wondering what do i need to do for her to not have to go into court ( she is only a witness )

I’d like to know how long do you have to wait to receive a court summons by mail in a shoplifting case from the time the incident occured?Police and LP didn’t make me sign anything and I was left to go home.The LP retained the merchandise I stole which was of $42 value.They also didn’t give me any copies of the paperwork they did on the spot.Police just told me to wait for a letter from the Court in mail.Please help. Also it is my first offence.

summons vs. tickets ??
i received a summons after getting pulled over for speeding. i have gone to driver retraining twice already. i know its hard to believe due to my driving recorded but i am not a bad driver and in fact was not speeding the last time i got pulled over. apart from that, what is a summons and is it better then getting a ticket in my case ?

I was sent a summons for a credit card debt. I checked the statute of limitations (Washington State) and found the debt to be past the allotted time. There were also some other problems with it but this seemed the easiest way to deal with it. Problem now is the lawyer has not responded to my Answer or Counterclaim. What do i do now? P.S. I find this system that allows a lawyer to submit a summons without actually having to file a claim with the courts BOGUS! They can send summons to anyone saying you owe anything and if you don’t answer within 20 days you default and they don’t have to pay the filing fee!!!

I live in Schoharie County, NY. My bank accounts were frozen by a lawyer for a collection agency. The lawyer posed as the collection agency when freezing the account, leaving their number with the collection agency name with the bank. I was told I was served at a former address, but it wasn’t me who accepted the papers. At first, the lawyer said the woman said she knew me, but then quickly changed his tune when I questioned him on it. He said I was served, even if it wasn’t me, so it was MY fault for not living there or responding before the freeze. The papers (to my knowledge) had account numbers, names, addresses, and social security numbers. The woman who accepted those papers is the complete opposite physically of myself. Is it legal for them to give the papers to someone else?

What if your being sued and you sign a hold harmless agreement and negotiate with the other party and you were under duress. Can you re-open the case?
