Can the Trustee sell your home if the attorney filed a TRO??
I am behind on MTG payments and due to the TRO the bank can not give me any information (to reinstate)

MY WIFE & I BOUGHT 2 PROPERTIES AT A COUNTY TAX SALE THAT ARE LOCATED IN A PROPERTY OWNERS ASSOCIATION. THE P.O.A.’S TREASURER IS SENDING US ASSESSMENT FEE BILLS DATING BACK TO 1989, WHEN WE ONLY PURCHASED THE PROPERTIES IN THE FALL OF 2007. WE’VE PAID OUR ASSESSMENT FEES SINCE THE PURCHASE DATE, BUT HE REFUSES TO CLEAR OUT THE REMAINING DEBT AFTER E-MAILS & 2 CERTIFIED/SIGNATURE VERIFICATION LETTERS, POINTING OUT TO HIM THAT THE P.O.A.’S OWN BYLAWS PREVENT HIM FROM CHARGING BEFORE OUR PURCHASE, NOT TO MENTION THAT THE COUNTY TAX SALE SHOULD EXTINGUISH INFERIOR LIENS ON THE PROPERTIES. WE REQUESTED A HEARING BEFORE THE BOARD LAST YEAR IF HE WOULDN’T SHOW OUR DEBT AS “CLEARED,” BUT HE NEVER RESPONDED, AND WHEN I E-MAILED HIM TO SEND OUR BILL FOR 2010, WHICH HE HADN’T MAILED YET THIS YEAR, IT STILL SHOWS ALL THE OLD BACK ASSESSMENTS TO 1989. MY QUESTION IS, WHAT IS MY RECOURSE? CAN YOU PLEASE GIVE ME SOME MORE CONCRETE TX LAWS THAT PROTECT ME IN THIS INSTANCE? THANK YOU IN ADVANCE FOR ANY HELP YOU CAN PROVIDE.

My grandparents own about 12 acres of property in New Hanover County, NC. As thier children have grown up and started families of thier own, they have given them each an acre with which to build a home. There is a total of 4 existing homes on the property with individual deeds and owners for each developed acre. The last child in the family is ready to get married and build a home of his own. But when he went to have a title drawn up for his acre they were informed by the planning board that the area would now be considered a housing development. They will have to leave a large portion of the remaining land for county use as a “park” or face fines. I have been told that it probably will not be used for a park but reserved so that the county can use it as they see fit. I am curious if there are any legal action we can take to keep this land in the family. I’m sorry for the long explanation but I wanted to be as detailed as possible. Thank you in advance for any insight you may be able to provide.
I have an issue in which my father sold me a piece of property, which is connected to another piece of property in which a home is on, the home and lot are directly connected and described in the mortgage and 2nd mortgage, the lot sold to me is not described in the mortgage, however my parents have both passed away in 2009, and the mortgage company was given their mortgage back to satisfy their debt by an estate guardian, the mortgage company re-wrote the mortgage documents to include the property that my father sold me, do I have any legal stance in this matter.

I live in Texas. Can an HOA prohibit homeowners from using a realtor when selling their home? My HOA has a rule that states that no realtor may list and show property. This sounds like a restriction of free enterprise and trade as well as making it almost impossible for homeowners in a remote area (on a small lake in East Texas) to sell. I would appreciate your advice.

Sir,
Me and my friend have leased an apartment in Massachusetts. We also have another person staying with us since Sept 2009. He had verbally agreed to share the rent (40% since he uses the larger room, 30 % and 30%)until Sept 2010. Now he wants to shift to another place (from Jan 2010) without paying the rent from Jan 2010. Do we (me and my friend) have a say in getting the rent share for Jan 2010 to Sept 2010 which he verbally agreed to pay. Or did we make a mistake in not getting a signed contract from him?
