me and my soon to be ex split up 4 months after he went on disability, he has been collecting workmans comp for 2 yrs since and soon will be settling with them for a lump sum the judge is aware of this and my ex was to notify his workmans comp attorney and they are to notify me when he receives the settlement. I’m asking for 1/2 since we were married for 28 yrs, had 2 children and the marriage ended due to he infidelity I’m having a heck of a time just getting the 125 on the 1st and the 15th from him is there a form that I can submit to the judge that can be forwarded to workmans comp and they can pay me directly since I know he will not give me what I’m entitle to. Also he is now getting a small portion of that settlement along with sdi.
california ex needs some advice please.

snow hill, NC at mediation signed a msa and mra which only listed the specifics of the settlement and that i would receive a more detailed final copy and an agr these are to be signed and then sent for judges approval however just received the final copy apparently prepared by employer and insurance co it was full of lies, wrong information, just enough detail to make them look good but not telling the whole story, important things left out and on the release and waiver of employment section where at mediation i was asked to resign yet in this detailed copy that i just received the work termination is used and that i have the right for unemployment i will not sign these papers what happens is i don’t sign them do they withdraw the lump sum settlement and i go with the live time weekly checks it says that after i sign i have 7 days to serve a written notice of revocation but at this point every paragraph in 17 pages would require changes because the statements are not correct so do i have to sign then do the revocation or just not sign at all and then what happens

I have been on short term disability through my employer since December 1st. It is due to expire June 1st. I have been seeking treatment for anxiety, depression, panic attacks and agoraphobia. I also have asthma which triggers a lot of attacks. What should I apply for (ex. SSI, SSD, etc.) I am not clear as to what the differences are and all that I can apply for. I do not see myself being able to return to work for quite a while, if at all. I can not drive due to this, nor can I go into certain places, deal with a lot of stress, certain lighting affects me, I can’t concentrate, focus or remember a lot. Are my chances for approval for SSI and/or SSD higher because I was approved for short term disability originally? What steps should I take? Thank you!

One of my students aimed a laser pointer to my left eye which has caused at least a temporary injury (poor vision) which may be permament. The student has since been expelled for 12 mos. and charged with assault. I should say this occurred on sovereign tribal land exempt from State Worker’s Compensation rules.
If my injury does not heal up and winds up permanent who has liability because the child and his family live a very meager existence already? My school has stated they will pay my medical bills via their insurance coverage but I’m in pain and suffering daily while trying to recover my vision. Should I retain a personal injury attorney to protect my long term interests.

I am currently living in Nevada, but moving to WA state. I have been on workmans comp for the last 6 months, and have filed for medical retirement.
The move is not voluntary, but due to my house being taken in foreclosure. I’ve notified my employer, OPM and DOL of the move, and no one seems to be concerned about it.
I am concerned that my job may try to fire me for job abandonment. Since I am still on their employee roster [only on paper] can they do that, and if so aren’t they responsible to warn me? DOL has not responded yet to my certified letter, but I basically requested my case be transferred to WA state.
Do they transfer cases readily, or do they commonly refuse to do that as well?
Thanks for your help. I’m trying to be proactive and find solutions before anything happens

I was injured (exposed to toxic fumes..still sick) at work about 3 days before I planned to submit a resignation. I had an opportunity to do the same work from home but through a different company(no competition issues). So here I sit injured with a 90 review for WC and the other job isn’t ready now for another several weeks. The reason for 90 day review is “your doctor didn’t say your injury is work related”..what? (california)

If I have a workers comp settlement that is to be used for my lifetime care that is going to be awarded to me due to my inability to work any longer, if I get married will I be responsible to share my settlement or will it go to his back child support in which he currently pays on. I live in California I just wanted to see if we should wait to get married till after my case is over?
