I WAS REAR ENDED ON THE HWY. TO MAKE A VERY LONG STORY SHORT. THE LADY THAT HIT ME HAS ALLSTATE INSURANCE. THEY DO NOT WANT TO COVER MY LOST WAGES, OR ALL OF MY MEDICAL BILLS. THEY TOLD ME THEY ONLY COVER WHAT IS REASONABLE AND CUSTOMARY. WHEN I ASKED WHAT THAT WAS SHE SAID THEY CHARGED MORE THAN SOME PROVIDERS CHARGED FOR THE SAME SERVICE SO THE ONLY PAY THE LESSER(REASONABLE)AMOUNT. I TOLD HER I WAS THE ONE HIT FROM BEHIND AND I WAS NOT GOING TO BE STUCK WITH ANY OF THE MEDICAL BILLS. THEIR CLIENT PAYS A MONTHLY PREMIUM TO COVER SUCH ACCIDENTS LIKE THIS. SHE INFORMED ME THAT I NEEDED TO SETTLE FILE A LAWSUIT BECAUSE THERE IS A STATUE OF LIMITATIONS ON AUTO CLAIMS. I WAS HIT APRIL 11, 2008. WHAT IS MY DEADLINE?

I was the plantiff in a criminal case of assault and battery. The defendant was found guilty. I would like to file a civil case for emotional distress, how long do I have to do this? The crime happened August of 2007. A judgment for the criminal case was not made until May 2008. I reside in Red Springs, NC. Thank you.

My daughter had an accident where she received a neck injury. The other driver was ticketed. She had Physical Therapy–bills of $1,100. Two years after the accident their insurance company offered to close for $1,600. Since she was still having some neck pain we decided to wait. Because she’s a full time college student she never really pursued more treatment and another year went by. Now they tell us the statute of limitations is up and we have no recourse. How can the victim of an accident not even get compensated for actual medical expense when it was documented and submitted??? We had no idea or we would certainly have settled. This seems completely unethical for the victim. Any recourse?

We are trying to recover damages to our company vehicle through the other driver insurance. The accident was on September 10, 2007. We have been going back and forth for the past year because they are claiming that their driver was only 60% at fault.
