I was involved in a car accident 18 years ago and I have 2 children that were also they will be turning 18 in a few months. I had a law suit filed against the state, city, and government in clovis, new mexico this accident resulted in the death of 3 of our children and so did my sister but I did not know that she did and she died 2 weeks after she filed the case however I did not find these papers until tonight. How long is the statue of limitation for her son whom I have raised? Can he pursue this case when he turns 18 or can I do so on his behalf now?

Last April 2009, I was involved in a car wreck in which i rear ended someone. It was my father’s car, it was registered to him, and there was no insurance on the car. Just recently, both he and I received a letter from a law firm the person I hit’s insurance company has referred their case to. The amount in question for the wreck is approximately $16,800. My father is filing Chapter 7 bankruptcy, because he was unemployed from last April up until December, and there is no possible way he can pay the amount. Should I file for bankruptcy as well? I am a full-time college student, and my weekly income is about $200. Or instead of filing for bankruptcy, can I pay a certain amount each month to the company? My father’s bankruptcy lawyer said that I should wait and see what happens after he files, but I want to check other sources.

Christmas eve 1998 my daughter had to go off the road in order to not rear end a car in front of her making a left hand turn. She did not hit the vehicle. A van behind my daughter’s car, however, did rear end my daughter’s car to the point of putting a V in the back end. His vehicle had to be towed away and my daughter drove her car off. The police were called and a lady cop on a lightly rainy Christmas eve decided not to give any tickets to anyone. I believe the guy who rear ended my daughter should have received a ticket. My daughter has had neck troubles since then but at the time didn’t seem to be hurt. I called and talked with the lady cop and said that someone who rear ends another vehicle is supposed to receive a ticket. In this case it was so obvious. Has the statue of limitations run out on this accident. Thanks for your help.

I have just recently had a situation occur that my family is saying I should pursue. I’m not sure what to call it and if there is a case.

I have just been released from the hospital after spending a week there for major chest surgery. A surgery that should have been preformed 5 + years ago due to my car accident and was mistakenly missed, this has had me in different levels of pain ever since.

As soon as a month after the car accident in which i has hit by someone missing a stop sign.
I was dealing with the pain Not he usual “healing”…and being told to “get used to it” it will be there forever. This pain to me was not normal by any means and prevented me from doing so many things in daily life. Simple things such as running to get the newspaper on a cold morning, vacuuming the house, playing with my boys…and so on. I could do these things but I always paid for it in the initial pain and the pain soon after. Sometimes lasting at higher levels for hours to days.

It had been getting worse “Levels of pain and durations” And I have been telling my doctors almost every time we met that it hurts… they always said…. mentally get over it. ((I think they were just sick of me saying it) Lastly!:

I was told as recently as January 18th (Exactly this) ..that the “pain” was in my head. And what I needed to do was to flip a mental switch to resolve it.. I was asking for the 20th+ time for a medication switch, there had to be something else to relieve this chronic pain that this doctor (My Central Doctor, who each other doctor sends his reports to) something else for me, it has been hurting for FIVE YEARS and I Have been complaining for five years to have another look, he just said it would be a waste of an MRI.

This doctor was visibly annoyed and said the following, “David, do you have any idea how many people in this office deal with chronic pain!”
I said that I didn’t care and what I wanted was for the pain to stop. life was and is almost unbearable living with it. He again referred to what he and the others were saying. “get used to it”

Well I finally had enough of it, It hurt and on Feb 15th I went to the emergency room to explain and ended up having emergency surgery that day. The surgeon stated what I was living with had stemmed from my accident and the thought of getting used to it was nonsense. And over time would have done much worse things internally. Why did it take the emergency room to sort things out. (I’m getting my 8 or 9 inches of staples out of my chest next Monday. and I’m sitting here popping Percocet and using a breathing machine)

Guess that “Mental Switch” might not have worked out so well.

I crashed on December 10, 2009 in a parking lot. I hit three parked cars and so far all my insurance company has been able to tell me is that the cost for damages exceeds my coverage. While my coverage is 10,000 one car alone is charging 18,785. Is there any way for them to sue me, and ask more than the actual cost of their vehicles? Is there anyway for me to legally pay less than what they ask for?

while i was working, my van was damaged, we use our own cars to do community projects with disabled people and doing so a client accidently knocked a dolly onto the hood of my van. my company said they are responsible but only for my deductible of my insurance. is this true? and which type of insurance does it fall under collision or comprehensive.

I recently purchased a new car. At the time I only left proof of prior insurance on old car to the sales agent at dealership. A week later a car ran a red light and slammed my car into a semi. I have a fault accident, my car was totaled. After accident, I found out that my insurance is not covered for some reasons. The other side, they have an insurance, and their car was totaled too. I wondered if the judge will suspense my license? if so, how long? Will there be an lawyer that can protect my license? my car was involve in a hit and run accident,at the time i had full coverage in the car cause i still own the dealer,were i bougth car.but the car his still damage,and no one is helping me.i call the dealer and they don’t want to help me and they telling me tha they goin to give it to the insurance,without my permmision,cause they put it as total lost and i was against it cause off what they wanted to pay for it, i talk to the insurace inspector for a second chance,and he did. so somehow the insurance tell me that they spoke to the deal and had a agreement to fix the car,but i call the dealer and they keep telling me that they don’t know about that agreement a to stop calling tham and asking about the statu of the car to deal with the insurance, so i did.i call the insurance and they also playing games ,is like he said she said games and i need alot off help with this people.i need to solve this problem soon cause my fiance is missing alot of work.if someone is willing to help please contact me,the delar took my car without permission and wound give it back to me,dont know what to do
