EB2 Adjustment of Status Filing – Is it a must for us to go out of the country (US) first?

Relocated in US w/ whole family of 4 last May 2004 under L1/L2 Visas/I94 until 04/25/2007.

My wife gave birth to a boy on Sep, 2004 (for any significance), traveled home for 3-wks vacation, back to US on 01/30/2007.

L1/L2 got extended, valid until 04/25/2009. Effective 10/01/2008, while on PERM, my company adjusted us to H1B/H4 valid until 05/30/2010.

Feb 2009, my company laid me off, effective Apr 2009. My whole family remained here in the US, hoped to land job sooner.

On Jan 2010, my wife was approved with an H1B Visa, myself w/ 2 kids now on H4. Last Oct 2009, her I-140 (EB2) got approved!

Questions:
1) Can we file AOS/I485 without leaving and re-entering US fresh?
2) Can you give any advise that may work or help in the AOS/I485 w/o re-entering US?

as stupid as this may sound…i am wondering what will happen. I made a petition for my husband we are 19 and have a 1 yr old daughter..on july 7 yesterday sept 19 he received his work permit.. around aug he caught a breaking and entering in daytime charge…case is still open but i am worried they will deny the petition

any feedback please

a company were made a contract to Ahmed Albab regarding to a concert in Malaysia. Two days before the event, the company declare ahmed albab could not perform because he did not obtain a visa and work permit. Ahmed Albab claimed that the company responsible to obtain the necessary documents for him although there was no such term stated in the contract.since the company failed, Ahmed Albab intends to sue the company for losses he sustained as he incurred expenses greater than the amount of advanced payment made to him by the company.

apart from that, another artist refused to perform in the concert because they obtained another contract to perform elsewhere with higher fees. A day before the concert, another artist got injured. He already paid an advanced sum of RM5000.

Advise the company regarding these 3 problems..

I-20 Visa Question for M1

I have got an I-20. But due to some paper problem i am not able to take an interview date for M1 us visa and my i20 is going to expire on 27th July (before i have to report). What should i do now. It will take time to complete my paper work. Should i get new i20 or is there any way to extend it?

I am 54 years old, US green card holder since 1996. However I am not able to reside in US and staying in India to take care of my 76 year aged & sick mother. My mother is not willing to travel to US and I can not leave her alone in India as I am only child to her. My wife and children are US citizens and permanently residing in US.
It is now very difficult for me to leave her alone and travel to US every 6 months to maintain green card. At the same time, I may be required to travel to US anytime to attend any emergencies with my family in US.
If I surrender my green card, would the US government oblige and issue me 10 years multiple visitors Visa to travel to meet my family any time I may require.

i have been working for almost 9 years here in the united arab emirates. i started as a team member and resigned as a restaurant manager. i have never been involved in any case or record of stealing in my whole stay for this company. i resigned as per company policy by giving a 1 month notice before stopping from work. then my company ask me to sign the cancellation of my visa. and after few days that they cancelled it they asked me to go to the finance department because they are saying that i have problem on my inventory but not from the previous store that i’ve handled but from the store that i handled 5 months back.then i complained them to the labor office here and after that the pro of the company asked me to arrange it with the company. but the next day after that i tried to arrange it but they are still very unclear of what they really want. and the following day, they complained me to the police department for stealing raw materials and i was detained for a day and a half.
what should i do?
i felt harassed for putting me in jail without any valid reasons.

I live in plainfield, nj. I am 14 years old and I am from El Salvador and I have AN EMPLOYMENT AUTHORIZATION CARD (TPS). In the end of June I’ll be going to Brazil with my church members for a missionary trip for two (2) weeks. I want to know what I need to travel from the U.S to Brazil, and then come back to the U.S and be allowed to reenter?

I’m a Permanent Resident for 10 years now, and 2 weeks ago i lost my green card in which is expired recently, i wanted to know would i be penalized for this, or what should i do to get my green card replace or renewed?

My confusion is that if your card is lost, you replace it by filling out specific forms, and if needed renewal, there’s a different application form for it, so in my case what should i do since my green card is expired and lost? Would i have to just apply for renewal form since it is already expired even if its lost?

I’m not sure what to do, i need help.

My fiance and I want to get married. He is a permanent resident currently submitting his application for naturalization. I am able to join him on an F1 visa. My question is this. We would be married now but for the immigration constraints. I will be giving up everything in Canada to live with him as well as uprooting my son. We would like the security of a marriage while we are waiting for his citizenship. Is it possible to sign something in front of a New Jersey lawyer stating that we consider ourselves married with all the legalities that would fall upon married people? I realize that common law marriages are not recognized in the state of New Jersey, so I don’t know if such an agreement would be possible, or if it would hold up if something happened. Could you please advise on this? Thank you.

Hi,

I am on H1B visa and currently working with company B. I left Company A who sponsered my visa for non-payment of my salary. Now company A has filed a Lawsuite against me in NJ court and I have to reply within 35 days.
My Question is : Can I hire a Lawyer in VA, as I am working in VA. Or do I need to hire a NJ lawyer only ..
Please advice
