My dad was charged with 11357 (a)Possession of Marijuana in 1980. He was only incarcerated for 90day. He was innocent of all charges. What can he do to get this case expunge? This offense occurred in California. We relocated to Kansas. Would this charge be a felony or misdemeanor?

Hi, my name is Heather ******. My boyfriend Ryan ***** got arrested 05/05/2010. The cops pulled him over because they said his car was reported driving reckless on the day before. However neither Ryan nor I used the car all day. Then the cop says that he has a drug possession charge. They didn’t find anything on him. The K-9 searched the car and found nothing. They said that it was a prior case. Two weeks earlier we got pulled over and he came back clean. How do you pick up a charge like this without knowing anything about it? I just received from the da’s office saying that charges have been filed against me for possession of a controlled substance and that i need to appear in court on 5/6/10 or a warrant will be issued foe my arrest. being that i have never been arrested, sited or even issued a citation for this charge, i wander how this could be and what do i do, outside the obvious and show up for court.

In 1992, Charleston, SC, I was convicted of Conspiracy to Distribute Narcotics & Accessory. I plead guilty to Misdemeanor charges & was given 5 years probation. After 3 years I was released so that I could move to another state. I have since carried a notary public license for 12 years, and served on a jury. Now that I have tried to purchase a pistol I have discovered my charges are being viewed as a Felony.

In 1993 the laws were changed and due to the length of my probation that is the determining factor in being viewed as a felon. Isn’t there some sort of “grand-father” clause that would stand due to the 1992 conviction before the laws changed??

It is my understanding that I can get this expunged. Is this possible?
