I had a court order wage garnishment put on me when i worked for a company owned by a us person. i have since changed jobs recently and i was wondering if this garnishment is still in place? the company that i work for now is a foreign owned company and my payroll comes from another country outside of the US. I was living in Louisiana when I filed for divorce and the court order is from Louisiana. I currently live in Texas.

According to California law, does a creditor have to pursue all avenues to collect a debt before they can go after the co-signer?
My ex son-in-law skipped out on a loan with his credit union, they sued and got a judgement against me and are garnishing my wages. I sent in a Claim of Exemption, but the creditor is fighting it. I have a hearing coming up on 8/10/10 and I want to know my rights.

Ok, I need help. I’ve been working at the same job in Oregon for ~10years now. I just recently got married and the wife starts scanning over my online pay stubs and sees an odd ’3rd party pay’ on the pay stub that I had never looked for or noticed. It turns out that I’ve been improperly garnished for child support in Texas for the last 10 years!!!

Just about $24k has been garnished over this time. So I call the Texas Attorney General and discuss my case. They put a stop on the garnish, but tell me that too much time has passed to collect any of the money. Is this true? Is there a time limit to reply I must meet when I’m illegally garnished and not even notified? What should my next course of action be?

It is my understanding a judgment can be collected by a garnishment at 25% for 90 days in Oregon. If they are unable to collect the full amount of the judgment can they come back a week later and reissue the garnishment?

several years ago I co-signed on a loan for my niece. She quit school, left the state, and I was left “footing” the bill.
I have been paying these loan for several years, with about 8,000 dollars remaining to pay. I recently found out that she is back in the area were we live, working a job, and living debt free? Is there a way to attach her wages to pay the remaining 8,000?

My husband started a new job and when eligible for medical we elected to receive the coverage. This was effective in February 2010. Just now, I realized that he has not been having this premium being taken out of his check. When My husband informed them, AND NOT waiting for them to catch it, they proceeded to take the full amount of back premiums (almost $500.00)out of ONE weeks’ check, WITHOUT even the courtesy of notifying us! I don’t mind paying for the back premiums, but I’ve done HR/Payroll before; the state doesn’t even garnish more than half of your net pay. This was the result of someone at the company not doing their job right by not starting the deductions at the right time. Why should we (and our mortgage!) have to suffer the repercussion!?
