My house in Hillsboro, Or was foreclosed on December 14,2009. We tried to shortsell and out realtor said to stop paying payment and HOA fees. We just received a judgement to our door stating that we are being sued for past due HOA dues. Our realtor said that the dues would be picked up by the bank during foreclosure proceedings. Is this true? Are we liable for the dues? Also the night before the foreclosure happened, I got a phone call at 11:30 stating the fire alarms were going off. I got to the house and found that the water heater in the attic, the lines had burst. we had not been in the house for 6-7 months and had all the utilities shut off. Are we liable for the damage?

In Ohio, 3 years before my now wife and I met she bought a house. She became “in trouble” on mortgage payments 1 year before we met. The house went to foreclosure AFTER we got married. I’m still not responsible for that debt…correct?

Hello, My name is Chris. I live in Texas and had a house (in Hunt County) that was foreclosed upon in 2008. Weather it was a judicial foreclosure or non-judicial foreclosure I do not know. Recently I started getting calls from Green Tree Servicing again. Never have had pleasant interaction with them… But, I found it rather strange, since I no longer had a mortgage with them. They said I still owe them $40,000 and threaten to take me to court and levy my bank account if I did not pay. Can they do this? Need some advice as to how to handle this. From what I researched on the internet if the foreclosure was a non-judicial foreclosure they cannot come after me. Is this true or is it more of an idle threat???

My husband and I are very behind on HOA fees and owe $10,400 in HOA and legal fees. I recently got served at home with a foreclosure summons from the boards lawyer. Iam trying to ask for a settlement aggreement. But I want to know is what they are doing legal? The front of the documents say Foreclosure Summons but the documents go on about a Lien? I am in the state of NY.

Recently bought a foreclosed home in San Clemente, CA from Wells Fargo Bank/Premier Assets. I received a letter from the previous owner who was foreclosed on stating that the roof tiles that are piled next to the house are his personal property and he wants them back. The tiles were removed from the house during a major remodel and the house was foreclosed on before there were put back up. (currently no roof tiles on the house). Does he have a legal right to these tiles after a bank foreclosure and aren’t they considered part of the home and not personal property?

We bought a house in November 2008 that was a foreclosure. Upon moving into the neighborhood, we paid our 2009 dues. Today, more than a year after moving into the neighborhood, we were advised by the HOA verbally that we must pay the dues owed prior to our purchasing the house.

They have no records of payment nor could they produce any records on our property – they chose to have this conversation “in passing” out on the sidewalk of our neighborhood. Are we liable for the past due HOA dues prior to our purchase of this house?

I live in North Carolina and am renting a house that is being foreclosed and scheduled to be sold at the end of September. My lease is a year lease from 8-1-09 to 7-31-09. Is it true that I can now legally terminate my lease? I received a Notice of Foreclosure Sale recently that was dated 9-1-09.
