Is an past employer allowed to tell a prospective employer if and why an employee was fired in Nebraska.

I recently started a job through a staffing agency and on the third day at the job site, was told I had to leave because the staffing agency said I failed the criminal background check. I went to the KBI (Kansas B.I.) website and found no record for myself, as well as nothing on my DMV. The report that the staffing agency’s Background Check service sent me claimed I was arrested in 2003 for battery and served time. I’ve never been arrested for anything, so I dug into what was going on. Apparently there was someone with similar name and D.O.B. as myself with a criminal history, but obviously it wasn’t me. They are currently looking into my “dispute”, but I want to know what legal course of action I have for being falsely accused of a crime and being kicked off the job site until the matter is resolved because of it. So far I have only lost 4 days of work, but that adds up, not to mention everyone at that job now thinks I am a criminal.

Can a HOA board do background checks on new tenants that investors want to allow to lease their condo? Are there any legal steps a Tx HOA board can do to limit the number of renters in a community?

The high school that I went to in the 92-93 school year lost my transcripts and I am trying to get my diploma. They are telling me that there is nothing they can do to help and they have looked everywhere that they could possibly be. What should I do or what should they do to compensate for the thousands of dollars I will have to spend at the community college to make up their mistake thank you.

I have a felony battery charge on my WDOJ arrest record. It never happened, I was never “officially” charged, never brought in front of a judge, spent a few days in jail and that was it. I never heard of it again until I did my own criminal background check through the WDOJ. The DOJ says it can’t be removed because it is connected to a DUI that I was found guilty of. The arresting officer was upset because I wouldn’t submit to sobriety testing. In short he fabricated the charge. What can I do?

The school my youngest daughter’s school called me at work and wanted me to come pick her up. I was at work so I sent my oldest daughter. The Principle gets mad because I my daughter told if they had been doing their job the situation would not have happened the lady got mad called my daughter ghetto and told her to leave the property at which time my daughter left. The lady followed her to her car still yelling for her to leave. When my daughter got home the police came and trespassed my daughter saying that my daughter was threatening kids. My daughter did not threat any kids and she left when she was asked. What can I do to get this charge removed from her record because it is hindering her getting a job.

I applied for a job on Nov 3,2009 this agency required fingerprints to be taken by me on Nov 7, 2009 My prints came bac today and my record showed two convictions . first one was petty theft way back in 1993 the other was in 2006 i was accused of welfare fraud i went to court pleated no contest and they dropped it to a misdemeanor and gave me 3 yrs probation. on the application it asked me have you ever been convicted of a felony other misdemeanor other than marijuana if it is more than two years after the date of the conviction? I answered no . i went to court on dec,2006 and judge gave me 3 yrs probation and dropped to misdemeanor. is that lying?? its been more than two yrs so do i have a right to put no?? they declined my position and said cause i was dishonest.
