I have been charged of two cases of card fraud in Virginia. I went to court today it is to be continued because the prosecutor did not show up (actually this was half the reason). The victim showed up with her mom and she wants me to get a felony (my attorney tried to bargain for two misdemeanors). Her mother however wanted to drop the whole thing. Any suggestions in possibly changing her mind until the next court date in which will be coming up in a month? And, if she does decide to change her mind, is there a chance in dropping the whole thing just because she said so? Or does the prosecutor have a say in giving me misdemeanors/felony

I actually meant that the daughter wanted to press full charges while the mother wanted to drop them. I do have a defense attorney but he has told me that the only way to get the charges lowered to misdemeanors is for the daughter to change her mind. I am just hoping her mother has some influence on her decision.

I would ask your defense attorney if you are allowed to write a letter to the mother, pleading with her to drop the charges. I’m not sure you want to admit any guild of the credit card fraud, but let her know you are just trying to live life like everyone else. Obviously, have your attorney review any letter or corresponce with the other side of this case.

I’m a little confused, at first you state the mother wants to press charges for a felony rather than a misdemeanor. Your next sentence says she wants to drop the charges. Not sure which is right. In anycase, do you have a defense lawyer? Public defender? If not, get one before the next hearing. You don’t want a felony or a misdemeanor on your record. If you have a defense lawyer, ask them what they think about the mother.
