Car Accident Attorneys in Wilmington Delaware

I was involved in a car accident in Wilmington, Delaware about 2 weeks ago. Can someone please let me know what steps I need to take to get money from the person that rear-ended me. I was contacted by the other persons insurance company and I have yet to call them back.

Any information and steps / procedures would be greatly appreciated.

You have two different options. You can handle the case yourself by dealing directly with the insurance company or you can hire a car accident lawyer. My suggestion is that if you hire a car accident attorney you hire one that represents cases in Delaware and more specifically Wilmington, DE.

Do understand that typically insurance companies will do an assessment of the damages and injuries that may have occurred and try to settle the claim out of court. Their main goal is for you not to take legal action against them. If you decide to go down this path be wise to what you say to them. Oftentimes people say things they shouldn’t say to these companies and their compensation spirals downward.

If you decide to hire an attorney do understand they will take a percentage of your compensation for representing you. This sometimes can be the best decision in the event the insurance company doesn’t do a fair assessment.

If you were injured I would hire a personal injury attorney / car accident attorney because ongoing medical expenses are oftentimes left out when the insurance company makes their offer.

Thank you for your response! This is very helpful. Are you from Delaware and if so, do you have a recommendation on a law firm or a lawyer that handles these types of cases. I was hit during a visit to Wilmington as I’m from a different state. Do I have to hire a lawyer from Delaware or can I hire one that is located in my state? I just don’t want to spend the time going all the way back down to Wilmington to have to meet a lawyer. In fact, I want to stay out of Wilmington all together!

Look above your question. There is a search bar of an all attorney search engine. Do a search for personal injury lawyers and pick two or three from the results and call around.

You should be able to gage how successful a personal injury lawyer is by looking around at their website.

No problem; Targetlaw is a pretty good search engine to find an attorney so I would too recommend looking there for an attorney. I can’t give you a recommendation on an attorney located in Wilmington. Do understand that personal injury cases are much different than other types of legal cases. You are not required to meet with them face to face. They can handle your case over the phone. I would still recommend using a personal injury attorney in Delaware or the city of Wilmington.

I would be a little more specific when doing the search. Do a search for Delaware personal injury lawyers. Than go through the process mentioned above. Hope this helps!

Thanks and I’m sorry if this was a stupid question. I have never been involved in a car accident and really have no idea what to do and the best approach to getting my fair share.
