I recently moved back to Leavenworth, ks in February of 2008. I had moved to Junction City, KS Near the end of 2002, and then on post late 2003. Once I moved back into Leavenworth I am suddenly very popular with one company. Apparently I wrote a check in 2001 that bounced and now I’m being knocked off my bearing left and right. I get a letter hand delivered by a sheriff to appear in court and I don’t even get to talk to a judge. They send me to a table with the lawyer demanding payment in upwards of $700 which socked me. When I had no clue about the charges to begin with. He proceeded to practically call me a liar saying judgment was entered against me in may of 2003, I had received nothing about a court date at all. Then after discussing payments of sorts 2 weeks later they garnish my rent money right out of my checking account, costing me 3 days of stress, and haggling on the phone to find out what went where and why and how to fix it, and $35 in fees from my bank and my landlord’s bank… My question is: Is this even legal? What are the statute of limitations on this kind of thing and do I really have to just roll over and take it? They even refuse to put paperwork through with my married name which kept my released garnishment from going back into my account until i took a copy of my marriage license into the bank to prove i am me… And how is this all coming up suddenly now? why didn’t they ever send me anything when i lived just 2 hours away? or try garnishing my accounts then? Guess that’s several questions, I’m just very frazzled and at a lost of what to do I’m hoping to find a little help
