You also may want to consider if you roomate has enough assets to make it worth your while to sue for assault and battery. You will have to pay the plaintiff attorney either a percentage of the settlement or an hourly rate.

When I mean injury did you have to go to the hospital and are there medical expenses related to the incident? You can generally sue for an assault and battery case if the victim was injured.
