we had our truck being fixed at a facility out of someones house and the guy fixing it had his wife take it out for a test drive. she ended up flipping the truck and totaled it. we latter find out that they have no insurance and we are going to have to pay the deductible. what can we do/or what should we do about this situation? we find this very unfair because we were not involved in the accident at all. it was at a repair facility.

Yes you can file a lawsuit against the person. When a person doesn’t have insurance you will have file a suit against the actual individual.

Because they don’t have insurance doesn’t mean you can’t sue them. I would file a lawsuit against their company or the person responsible for the repairs. Contact a personal injury lawyer and he or she can file the claim for you.
